Unconscious man with vomit on his shirt charged with impaired

On July 1, 2018 at 1:09 a.m., the East Algoma Ontario Provincial Police members were on general patrol duties on Highway 108 in the City of Elliot Lake, Ont.

A parked pickup truck was observed in a lot near Horne Lake, adjacent to Highway 108. The driver's side door was open and a male was sitting in the driver's seat (allegedly) passed out. There was a large puddle of vomit on the ground directly outside the driver's door and the male had vomit down the front of his shirt. When police woke up the male, a strong odour of alcoholic beverage was detected emanating from his breath. He was subsequently arrested and his driver's license suspended.

Jose Santos Da Silva, 30 years of age, from Elliot Lake, Ont. was charged with:

  • Care or control while impaired (alcohol), contrary to section 253(1)(a) of the Criminal Code (CC),
  • Care of control over 80 mgs, contrary to section 253(1)(b) of the CC.

The accused is scheduled to appear before the Ontario Court of Justice in Elliot Lake, Ont. on Aug. 7, 2018.
