Police seize firearms following single vehicle crash

Police say the 33-year-old was seen walking along Highway 639 near Flack Lake and showed signs of impairment

On Sept. 2, 2022, at approximately 9 a.m. the East Algoma Ontario Provincial Police (OPP) received a call regarding a possible impaired driver who crashed into the ditch on Highway 639 north of Elliot Lake.

The complainant reported that a small white Sport Utility Vehicle (SUV) was in the ditch and that the male driver looked to be impaired. He was walking with a child along the Highway near Flack Lake.  

Police attended and the driver was spoken to, who exhibited signs of impairment. In addition, there were numerous firearms in the vehicle that the driver was not supposed to possess, and his driver's license was suspended. As a result, the driver was arrested and the vehicle was towed and impounded. 

Collin Day, 33 years old, from Serpent River First Nation was charged with:

  • Operation While Impaired - Alcohol and Drugs, contrary to section 320.14(1)(a) of the Criminal Code (CC)
  • Dangerous Operation, contrary to section 320.13(1) of the CC
  • Unauthorized Possession of a Firearm (Three Counts), contrary to section 91(1) of the CC
  • Knowledge of Unauthorized Possession of Firearm (Three Counts), contrary to section 92(1) of the CC
  • Occupant of Motor Vehicle Knowing there was a Firearm (Three Counts), contrary to section 94 of the CC
  • Novice Driver - Presence of Drugs, contrary to section 44.2(4) of the Highway Traffic Act (HTA)
  • Driving While Under Suspension, contrary to section 53(1) of the HTA

The accused is scheduled to appear before the Ontario Court of Justice in Elliot Lake on Nov. 8, 2022.

The OPP reminds motorists that no amount of alcohol or drug is acceptable to consume and drive. Report impaired drivers. Should you observe a suspected impaired driver, please dial 911 or contact the Ontario Provincial Police at 1-888-310-1122.
