Rider admits he was impaired in 2018 ATV crash that injured one

A district man pleaded guilty last week to impaired driving causing bodily harm in connection with an ATV crash that occurred four years ago.

Brett Morningstar will return to court Dec. 13 for sentencing.

The accident occurred July 20, 2018 in the municipality of Huron Shores, Superior Court Justice Michael Varpio heard Friday.

When police arrived at the scene shortly after 9:30 p.m., Morningstar indicated he was fine, explaining "I was driving. I just lost it, "

Morningstar's eyes were glossy and the officer noted a strong odour of alcohol, prosecutor Karen Pritchard said.

When asked if he had been drinking or using drugs, he replied "I was drinking around 5 p.m., since then, but I don't do drugs."

Morningstar was arrested for impaired operation and transported to hospital because of his injuries.

At 10 p.m. blood samples were taken for medical reasons, the assistant Crown attorney said.

When police were preparing to take breath samples the accused said not to bother, indicating he was "blasted."

Just before 11:30 p.m., Morningstar was throwing up and couldn't provide a breath sample, Pritchard said. 

A forensic toxicologist later prepared a report tracing back what his blood-alcohol level would have been at the time of the driving.

The expert determined his readings were 167 and 197 milligrams of alcohol in 100 millilitres of blood, the court heard.

Another person, injured in the crash, was transferred to hospital in Sudbury with four fractured vertebrae and seven broken ribs.

"He continues to suffer back and shoulder pain and sometimes loses feeling in his left leg," Pritchard said.

This has resulted in a loss of employment, anxiety and depression.

Defence lawyer Antoine-Rene Fabris requested pre-sentence and Gladue reports be prepared for the sentencing hearing.
