City ordered not to fill Chris Patrie's vacancy pending appeal

On Feb. 13, Justice Burke of the Ontario Superior Court of Justice in Sudbury heard submissions from lawyers representing the City of Elliot Lake, the city’s Integrity Commissioner (IC) and former Mayor Chris Patrie.

Justice Burke ordered the city not to take any steps to fill the vacancy in the head of the council until such time as the appeal of Chris Patrie is heard and determined by the Divisional Court. The judge also agreed to add the city as a party to the proceedings and to set a court date for a one-day hearing during the week of April 11-14 to hear Mr. Patrie’s appeal of the ruling from Justice Rasaiah released on Jan. 9.

Justice Burke’s order will allow the city to legally remain with a vacant mayoral position beyond the required 60-day period in the Municipal Act, 2001 for a determination on how to fulfil the vacancy. Acting Mayor Andrew Wannan, council and the city administration are committed to advancing municipal operations and decision-making as seamlessly as possible during this interim period.

“The city remains focused on operations while simultaneously looking out for the city’s interests in the Patrie appeal. I appreciate and respect our residents’ interest in this case, but with all matters before the courts, many details must be kept confidential to protect the rights of all parties in the judicial process," Wannan added. 

The city will continue to notify the public as appropriate under the circumstances. Justice Burke's order and other relevant court documents are listed on the city's IC page.
