Vehicle fails to stop, multiple charges follow

Investigation revealed the driver was suspended and he had suspected cocaine in his possession

On Feb. 17, 2018, the East Algoma Ontario Provincial Police members were on regular patrol duties on Beach Road and Spruce Avenue in the City of Elliot Lake, Ont.

At 4:35 p.m., police observed an off road vehicle (ORV) fail to stop at an intersection. Police subsequently stopped the ORV and spoke to the male driver. After investigation, it was learned the driver was suspended and he had suspected cocaine in his possession.   

Robert Falconer, 38 years of age, from Elliot Lake, Ont. was charged with:

  • Driving while under suspension, contrary to section 53(1) of the Highway Traffic Act (HTA),
  • Possession of a schedule I substance - cocaine, contrary to section 4(1) of the Controlled Drugs and Substances Act (CDSA),
  • Driver fail to surrender license, contrary to section 33(1) of the HTA,
  • Disobey stop sign - fail to stop, contrary to section 136(1)(a) of the HTA,
  • Fail to have insurance card, contrary to section 3(1) of the Compulsory Automobile Insurance Act (CAIA),
  • Drive off-road vehicle - no permit, contrary to section 3(1) of the Off Road Vehicle Act (ORVA).

The accused is scheduled to appear before the Ontario Court of Justice in Elliot Lake, Ont. on March 7 and April 10, 2018.
