ONTARIO PROVINCIAL POLICE

On Jan. 12, 2021, at approximately 11:23 a.m. members from the Manitoulin Detachment of the Ontario Provincial Police (OPP) responded to a traffic complaint, in Sables-Spanish Rivers Township.
Police located the vehicle and upon speaking to the driver, determined driver to be under the influence of a drug. The driver was arrested and brought for further investigation to Espanola detachment.
A Drug Recognition Expert (DRE) investigation was completed and as a result, the driver Jessica Tabachak, 33 years old, of Wikwemikong Unceded First Nation Reserve was charged with:
- Operation while impaired - alcohol and drugs, contrary to section 320.14(1)(a) of the Criminal Code (CC),
- Possession of a Schedule 1 Substance - heroin, contrary to section 4(1) of the Controlled Drugs and Substances Act (CDSA),
- Possession of a Schedule 1 Substance - opioid (other than heroin), contrary to section 4(1) of the CDSA,
- Drive vehicle or boat with cannabis readily available, contrary to section 12(1) of the Cannabis Control Act (CCA) 2017,
- Driving while under suspension, contrary to section 53(1) of the Highway Traffic Act (HTA)(two counts),
- Drive motor vehicle, no plates, contrary to section 7(1)(b)(i) of the HTA,
- Drive motor vehicle, no permit, contrary to section 7(1)(a) of the HTA, and
- Operate a motor vehicle without insurance, contrary to section 2(1)(a) of the Compulsory Automobile Insurance Act (CAIA).
The accused was released on an Appearance Notice and also on several Provincial Offence Summonses and is scheduled to appear at the Ontario Court of Justice on March 1, 2021, in Espanola.
The accused was issued a 90-day Administrative Driver's Licence Suspension (ADLS) and the vehicle was impounded for seven days.
