Operator charged after converting 'e-bike' to 'motor vehicle'

On Nov. 20, 2018 at 1:18 a.m., the East Algoma Ontario Provincial Police members were on regular patrol duties on Highway 108, in the City of Elliot Lake, Ont.

Police observed a northbound e-bike operating with no red light to the rear. A traffic stop was initiated and investigation revealed there were also no pedals attached to the e-bike. This now meant the e-bike was not able to be pedalled to provide muscular power. As a result of this modification, this now changes the definition of an 'e-bike' to that of a 'motor vehicle,' according to the Highway Traffic Act (HTA). Additionally, the male driver was found to be suspended. 

Joseph Newton, 59 years of age, from Elliot Lake, Ont. was charged with:

  • Drive without proper rear light - motorcycle, contrary to section 62(2) of the (HTA),
  • Drive motor vehicle, no permit, contrary to section 7(1)(a) of the HTA,
  • Driving while under suspension, contrary to section 53(1) of the HTA.

The accused is scheduled to appear before the Ontario Court of Justice in Elliot Lake, Ont. on Feb. 6, 2019.
