Man charged after disturbance at gas station

On Sept. 15, 2017, at approximately 2:07 a.m., members of the East Algoma Ontario Provincial Police (OPP) responded to a disturbance call at a local gas station on Highway 108 in Elliot Lake.

The complainant had reported a male outside the building causing damage to property and throwing items at the window. The male was subsequently arrested.

Darryl Newton, 46 years of age of Elliot Lake, Ont., was charged with:

  • Mischief - destroys or damages property (two counts), contrary to section 430(1)(a) of the Criminal Code (CC)
  • Fail to comply with probation order (three counts), contrary to section 733.1(1) of the CC
  • Assault, contrary to section 266 of the CC
  • Assault a peace officer, contrary to section 270(1)(a) of the CC

The accused was scheduled to appear before the Ontario Court of Justice Bail Court in Sault Ste. Marie, Ont. on Sept. 15, 2017.
