Man accused of stealing from family member, assaulting them: OPP

On April 18, 2021, at approximately 7:30 p.m. members of the East Algoma Ontario Provincial Police (OPP) were called to a theft related occurrence on Dieppe Avenue in Elliot Lake. 

The complainant reported a family member had assaulted them and then stole their cell phone and credit cards on the night of April 17. The family member proceeded to attempt to withdraw cash from numerous places in town. Police obtained video surveillance showing the person using the cards.

On April 18, 2021 after police investigation, the accused was located, arrested, and charged. 

Spencer D'amato-Kosch, 20 years of age, of Elliot Lake was charged with:

  • Theft under $5000, contrary to section 334(b) of the Criminal Code (CC),
  • Robbery with theft, contrary to section 344(1)(b) of the CC,
  • Fraud under $5000, contrary to section 380(1)(b) of the CC,
  • Assault, contrary to section 266 of the CC,
  • Theft of credit card, contrary to section 342(1)(a) of the CC,
  • Use of credit card, contrary to section 342(1)(c) of the CC,
  • Use of credit card data, contrary to section 342(3) of the CC,
  • Possess credit card data, contrary to section 342(3) of the CC,
  • Possession of a credit card, contrary to section 342(1)(c) of the CC.

The accused is scheduled to appear before the Ontario Court of Justice in Elliot Lake on June 8, 2021.
