Expired tag nets charges for Elliot Lake driver

Investigation revealed his vehicle did not have the required ignition interlock device

On July 13, 2019 at 1:17 p.m., the East Algoma Ontario Provincial Police (OPP) members were on regular patrol duties on Hillside Drive South in the City of Elliot Lake, Ont.

A pickup truck was observed to have an expired validation permit on the licence plate. Subsequently, police conducted a traffic stop and investigation revealed the male driver did not have a driver's license and his vehicle was required to have a mandatory ignition interlock, which it did not have. As a result, the male driver was arrested and charged. In addition, his pickup truck was towed and impounded.

Joseph Leandre Guignard, 59 years of age from Elliot Lake, Ont. was charged with:

  • Operation while prohibited, contrary to section 320.18 of the Criminal Code (CC),
  • Operate a motor vehicle without insurance, contrary to section 2(1)(a) of the Compulsory Automobile Insurance Act (CAIA),
  • Drive motor vehicle not equipped with an approved ignition interlock device, contrary to section 41.2(13) of the Highway Traffic Act (HTA).

The accused is scheduled to appear before the Ontario Court of Justice in Elliot Lake, Ont. on Sept. 3 and Sept. 4, 2019.
