Elliot Lake driver charged with impaired near Massey

SABLES-SPANISH RIVERS TOWNSHIP - On Sept. 12, 2020 at approximately 9:31 a.m., members from the Manitoulin Detachment of the Ontario Provincial Police (OPP) were conducting traffic enforcement on Highway 17, Sables-Spanish Rivers Township.

A vehicle approached the officer's location, travelling well in excess of the posted 90 km/h zone. Officers stopped the vehicle and while speaking to the driver, concluded alcohol had been consumed. The driver was given further testing and subsequently arrested. Officers also observed suspected cannabis available to the driver and located a quantity of unmarked cigarettes.

As a result of the investigation, the driver Darryl Beauchesne, 39 years old of Elliot Lake was arrested and charged with:
    •    Operation while prohibited under the Criminal Code, contrary to section 320.18(1)(a) of the Criminal Code (CC);
    •    Race a motor vehicle - excessive speed, contrary to section 172(1) of the Highway Traffic Act (HTA);
    •    Driving while under suspension, contrary to section 53(1) of the HTA;
    •    Drive vehicle or boat with cannabis readily available, contrary to section 12(1) of the Cannabis Control Act 2017 (CCA2017); and
    •    Possess unmarked cigarettes, contrary to section 29(2) of the Tobacco Tax Act (TTA).

The accused was given Provincial Offences Summons as well as an Appearance Notice and is scheduled to appear at the Ontario Court of Justice on Nov. 2, 2020 in Espanola.

The accused was issued a seven-day driver's licence suspension and given a notice of motor vehicle impoundment for 45 days under the Criminal Code.

The vehicle was towed from the scene.
