Ebike rider extends middle finger. Impaired charge ensues

On Aug. 10, 2018, shortly before 7 p.m., members from the East Algoma Ontario Provincial Police responded to a possible impaired driver on an e-bike on Hillside Drive South in the City of Elliot Lake.

Police located the e-bike with two male occupants on it. The e-bike motor was being used to power the e-bike and it was travelling uphill on Hillside Drive South just west of Hutchison Avenue. The officer pulled in behind the e-bike observed it to be weaving. The officer activated the emergency lights on his cruiser and hit the horn several times to get their attention. The driver of the e-bike put his left hand in the air and extended his middle finger at the officer. The e-bike pulled over and eventually stopped.   

The male driver was arrested and transported to Manitoulin-Espanola OPP Detachment where there was a qualified breath technician on duty. The male driver provided a breath sample of over 150 mg of alcohol in 100 ml of blood.

As a result of the investigation, Marcus Kitchen, 32 years of age, from Elliot Lake, Ontario was charged with:

  • Driving with more than 80 mgs of alcohol in blood, contrary to section 253(1)(b) of the Criminal.

The accused is scheduled to appear before the Ontario Court of Justice in Elliot Lake on Sept. 11, 2018.
